These Terms and Conditions govern safari enquiries, quotations, bookings and travel services arranged by Esperanza Tourism. By confirming a booking, making a payment or instructing us in writing to proceed with travel arrangements, you confirm that you have read and accepted these Terms and Conditions together with the applicable quotation, invoice, itinerary and any supplier-specific conditions disclosed before confirmation.
1. About Esperanza Tourism
Esperanza Tourism is a Kenya based travel and safari business providing safari planning, transport, accommodation coordination, activity booking and related travel services. 2. Quotations and availability
A quotation is an offer based on the information, rates and availability available when it is prepared. Accommodation, flights, park services, vehicles, guides and activities remain subject to availability until the required payment has been received and the relevant suppliers have confirmed the booking.
Unless a quotation expressly states that a price is fixed for a stated period, Esperanza Tourism may revise an unconfirmed quotation where supplier rates, exchange rates, taxes, park fees, conservation fees, fuel costs or government charges change before confirmation.
3. Booking confirmation
A booking is confirmed only when Esperanza Tourism has received the required deposit or other payment stated on the invoice and has issued written confirmation. A payment alone does not guarantee a service if a supplier has become unavailable before confirmation. Where this happens, we will propose a reasonable alternative or refund the amount received for the unavailable service if no acceptable alternative can be agreed.
4. Deposits and balance payments
The deposit amount, balance amount and payment due dates will be stated in the quotation or invoice. Some services, including certain lodges, flights, seasonal offers, exclusive-use properties and special activities, may require a higher deposit or full prepayment.
If a balance is not received by the stated due date, Esperanza Tourism may treat the booking as at risk of cancellation after reasonable notice. Any cancellation charges or non-refundable supplier commitments already incurred will remain payable subject to applicable law.
5. Prices and currencies
Prices are normally quoted in the currency shown on the quotation or invoice. Where a payment is made in another currency, the exchange rate and payment provider charges applying at the time of payment may affect the amount received. Bank, card, mobile money and payment gateway fees are handled as stated on the invoice or payment page.
6. What is included
The services included in a booking are only those expressly listed in the confirmed itinerary, quotation or invoice. Typical inclusions may include selected accommodation, meals, private safari transport, driver-guide services, park or conservancy fees and specified activities.
Anything not expressly listed as included should be treated as excluded. Common exclusions include international flights, visas or entry authorisations, travel insurance, tips, personal expenses, optional activities, premium drinks, upgrades and services requested after confirmation.
7. Traveller information
You are responsible for providing accurate names, nationality, residency category, travel dates, ages of children and any other information needed to make the booking. Names supplied for airline tickets, permits and other controlled services must match the relevant travel documents.
Costs resulting from incorrect or incomplete information supplied by the traveller may be charged to the traveller where they cannot reasonably be recovered from the supplier.
8. Passports, entry requirements and health
Each traveller is responsible for ensuring that passports, visas, electronic travel authorisations, vaccination documents and other entry requirements are valid for the journey. Requirements can change and may depend on nationality, residency, age and travel history.
Esperanza Tourism may provide general travel information, but this does not replace advice from the relevant government, embassy, health authority or qualified medical professional.
9. Travel insurance
We strongly recommend comprehensive travel insurance from the time a booking is confirmed. Appropriate cover should normally include cancellation, medical treatment, emergency evacuation, baggage loss, travel delay and other risks relevant to the itinerary. Insurance remains the traveller's responsibility unless the confirmed package expressly states otherwise.
10. Changes requested by the traveller
Requests to change dates, accommodation, route, traveller numbers, rooming, flights or other confirmed services must be made in writing. Changes are subject to availability and may result in supplier amendment fees, fare differences, additional park fees or other costs. We will explain the known cost before implementing a material change where practicable.
11. Changes by Esperanza Tourism
Travel in wildlife areas can be affected by weather, road conditions, park rules, wildlife movement, supplier operations, flight schedules, security considerations and other circumstances. We may make reasonable itinerary changes where necessary for safety, practicality or service delivery.
Where a significant confirmed service becomes unavailable before departure, we will use reasonable efforts to offer a comparable alternative. If the replacement is materially cheaper, we will adjust the affected portion of the booking where appropriate. If no reasonable alternative can be offered, the remedies available will depend on the circumstances, supplier recoveries and applicable law.
12. Accommodation
Hotels, lodges and camps are subject to their own check-in, check-out, rooming, child, meal and property rules. A named property may be substituted only where necessary and, where possible, with a property of reasonably comparable standard and location.
13. Safari vehicles and transport
Road safaris are normally operated using the vehicle type stated in the confirmed itinerary. Vehicle allocation may change where maintenance, safety, capacity or operational requirements make this necessary, provided the replacement remains reasonably suitable for the confirmed journey.
Travel times are estimates only. Kenyan road conditions, traffic, weather, wildlife activity, park entry procedures and other factors can affect actual timing.
14. Wildlife and natural events
Wildlife sightings are never guaranteed. Animal location, migration timing, river crossings, predator activity, bird concentrations and similar natural events depend on weather, habitat and normal wildlife movement. Descriptions on our website and in itineraries are planning guidance rather than promises of a particular sighting.
15. Activities and safety
Walking, cycling, ballooning, boating, horse riding, hiking and other specialist activities may carry additional risk and may be subject to age, weight, mobility, health, weather or operator restrictions. Travellers must follow the safety instructions of guides, pilots, rangers, captains and other authorised personnel.
Esperanza Tourism may decline or discontinue an activity where participation would reasonably create a safety risk or breach an operator or protected-area rule.
16. Children
Children are welcome on many itineraries, but age rules and pricing differ between lodges, airlines, parks and activities. Parents or guardians remain responsible for supervising minors unless a confirmed service expressly provides otherwise.
17. Conduct
Travellers must respect wildlife, protected-area rules, local communities, staff, other guests and property. Esperanza Tourism may end a service without refund where a traveller's behaviour creates a serious safety risk, involves unlawful conduct, threatens staff or other guests, or repeatedly breaches protected-area or supplier rules.
18. Third-party suppliers
We arrange services provided by independent lodges, airlines, activity operators, payment providers, conservancies and other suppliers. Those suppliers remain responsible for delivering the services they control. Esperanza Tourism will use reasonable care when selecting and coordinating suppliers and will assist with legitimate service issues, but we do not control every operational decision made by an independent supplier.
19. Force majeure and events beyond reasonable control
Events beyond reasonable control may include extreme weather, flooding, fire, epidemic, government restriction, civil disturbance, border closure, strike, road closure, park closure or major transport disruption. Where such an event affects a booking, we will work with the traveller and suppliers to seek a practical alternative, postponement, credit or refund to the extent available and required by law.
20. Cancellation and refunds
Traveller cancellations, no-shows, booking reductions, refund processing and supplier cancellation charges are governed by our Cancellation and Refund Policy, together with any specific conditions disclosed in the confirmed quotation or invoice.
21. Complaints during travel
If a problem occurs during the journey, please tell your driver-guide or Esperanza Tourism as soon as reasonably possible so that we have an opportunity to assist while the service is still being delivered. If the matter remains unresolved, send a written complaint through our Contact Us page or email info@esperanzatourism.co.ke with the booking reference and relevant details.
22. Personal data
Personal information is handled in accordance with our Privacy Policy and Cookie Policy. Optional website cookies are controlled through the cookie consent settings available on the website.
23. Website content and intellectual property
Website text, design, branding, photographs and other material may be protected by copyright, trade mark or other rights. Content may be used for personal travel planning but may not be commercially reproduced or republished without permission from the relevant rights holder.
24. Limitation of liability
Nothing in these terms excludes or limits a right or remedy that cannot lawfully be excluded. Subject to that principle, Esperanza Tourism is responsible for losses that arise from our own proven breach of contract or negligence to the extent recognised by applicable law. We are not responsible for losses caused solely by the traveller, an unrelated third party or an event outside reasonable control where the law does not impose liability on us.
25. Consumer rights
These terms are intended to operate consistently with applicable Kenyan consumer law. Nothing in them removes a mandatory consumer right. Kenya's legislation can be accessed through Kenya Law, including the Consumer Protection Act.
26. Governing law and dispute resolution
These Terms and Conditions are governed by the laws of Kenya, subject to any mandatory consumer protection rule that applies to the traveller. The parties should first try to resolve a dispute through direct written communication. Where a dispute cannot be resolved amicably, either party may use any lawful complaint, mediation, arbitration or court process available to them.
27. Changes to these terms
We may update these Terms and Conditions for future bookings. The terms applicable to an already confirmed booking are normally those accepted when the booking was confirmed, together with the specific quotation, invoice, itinerary and disclosed supplier conditions, unless the parties agree otherwise or mandatory law requires a different result.
